Possible copywrite infringement?

So....I have this ex-friend that awhile back I had designed an image for with the understanding that it was for personal use only.  (He wanted it to make a T-Shirt for himself)  and now I found out that he's using it for his business logo. 

There was no "contract" persay only emails back and forth about the design.

Do I have any recourse to get him to stop using it for a commercial purpose?

Yes, first off, just ask him. Call him up and just tell him that your art is copyrighted and he has not paid usage rights for commercial usage. He had the right to use the art for a single t-shirt and usage fees will apply for commerical usage.


Second, if he refuses or rebuffs your request, draft a "cease and desist" letter with a deadline for removal of the art or to be prepared for your lawyer to contact him.


How was this "art" created? Is it a photo or graphics or both?  If it's graphics, do you have all the drafts and files stored on your computer? Does he have all the versions or drafts in his posession?  Tell me more if you can about the process that occurred. 


Creative property theft is EVIL in my opinion and I had a photo I took ripped off by a major hotel chain. I simply ended up sending them a huge bill for usage rights and a cease and desist letter. They paid and stopped using the photo.
