My DH was injured on the job June 2009. He went to the approved doctor, took a drug test as required, and gave his employer ALL of the paperwork. The manager said it was "taken care of". Three months later we get a statement in the mail for $1500 for this incident from the hospital. He contacts the boss again, and the boss says he will "look into it" and calls back saying it should be taken care of this time.

Fast forward to Dec 2009, we get a letter stating that we are going to be sent to collections and taken to court if not paid within 30 days, DH contacts the corporate manager, HR department, and practically everyone in the entire company. He is told he has to send all the paperwork AGAIN and so he faxes it, emails it, and mails it all to them AGAIN. They said it was paid for in full and we should no longer be bothered about this.

Tonight, DH gets a phone call from a company trying to find out his current address to send him legal papers. They are bringing the papers by tomorrow, then we will have about 30 days to file an answer or go to court.

WTF do we do? Should we get a lawyer? We feel helpless!

Can you get a hold of his boss and let him know? He said he would take care of it so maybe he just forgot or something? 

I would call the boss and tell him what's up. If he denies this then you might have to take legal action.

Sarah, unfortunately we have talked to his boss over 10 times. And everytime he has told us in a different way, that it was taken care of.

He called him again today, and told him that we are being sent to court. His bosses excuse was "Oh I didn't realize this was such a big issue till today, Sorry"

So now we are talking to his boss, the corp manager, travelers insurance, and the collection agency. Attempting to get this all fixed (for what feels like the 100th time) before a garnishment is placed on our checks...

I hate to say this, but unfortunately if the company hasnt taken care of it already you may want to look into legal counsel. Usually the company has a contract with the approved dr so that the EE should never see a bill. Sounds like something fishy.. 

The same thing happened with us but with victims assistance, the hospital kept sending us bills so we had to call the hospital directly and told them what was going on and gave them the number of the person we were in contact with through victims asst. and it was handled!

I would call the billing/hospital/clinic that your hubby saw and tell them that it was a workmans comp issue and his boss has said numerous time that it 'was taken care of' and give the billing dept/hospital the boss'/HR dept. phone number.

I would also try to get an email/voice mail/text/recording of the boss/HR dept telling you it was handled that way if it does go to court then you have proof that they 'paid for it'

hearts - I don't know the status on this, seeings how it's almost a month later, but most Workman's comp issues are handled with a third part administrator (aka the insurance company).  You should have something with their name/phone number on it.  You need to get ahold of the claims administrator and find out why you even got a bill.  They may have denied the claim, or said that it's not related to a work issue, but if it was a workman's comp issue, you should have never seen a bill, period.
